{"id":5050,"date":"2024-11-11T22:34:37","date_gmt":"2024-11-11T21:34:37","guid":{"rendered":"https:\/\/dl-law.it\/?p=5050"},"modified":"2024-12-12T22:42:25","modified_gmt":"2024-12-12T21:42:25","slug":"notificazione-a-mezzo-pec-le-sezioni-unite-intervengono-sul-regime-pre-riforma-cartabia","status":"publish","type":"post","link":"https:\/\/dl-law.it\/en\/notificazione-a-mezzo-pec-le-sezioni-unite-intervengono-sul-regime-pre-riforma-cartabia\/","title":{"rendered":"NOTIFICATION VIA CERTIFIED EMAIL: THE SUPREME COURT IN FULL SITTING INTERVENES ON THE PRE-CARTABIA REFORM REGIME"},"content":{"rendered":"<p><strong>NOTIFICATION VIA CERTIFIED EMAIL: THE SUPREME COURT IN FULL SITTING INTERVENES ON THE PRE-CARTABIA REFORM REGIME <\/strong><\/p>\n<p>The Supreme Court in full sitting, with judgment no. 28452 of November 5, 2024, resolved the jurisprudential conflict regarding the completion of notification via certified email (PEC) in case of non-delivery to the recipient with the \"full mailbox\" notice.<\/p>\n<p>The issue, as the Court specifies, affects every area where the notification of a procedural act, carried out via PEC, results in non-delivery due to a cause attributable to the recipient.<\/p>\n<p>According to the Court, \"<em>In the regime prior to the Cartabia reform, notification via PEC carried out by the lawyer pursuant to art. 3-bis of Law 53\/1994 is not completed if the system generates a non-delivery notice, even for a cause attributable to the recipient (such as in the case of a full PEC mailbox with an error message stating 'full mailbox'), but only if the receipt of delivery (so-called <\/em><em>'RdAC') is generated: therefore, the notifier, if they must avoid the expiration of a deadline to their detriment, will be required to promptly reactivate the notification procedure through the ordinary forms provided for in articles 137 et seq. of the Code of Civil Procedure, thus benefiting from the moment when the acceptance receipt of the original notification sent via PEC was generated.<\/em>\u201d.<\/p>\n<p>This interpretation, according to the Court, is supported by the discipline brought by the 2022 civil process reform, and in particular by art. 3-ter of Law 53\/1994, inserted by art. 12, paragraph 1, letter b), of Legislative Decree no. 149\/2022, which regulates the effects of unsuccessful notification via PEC.<\/p>\n<p>This provision states that non-notification due to a cause attributable to the recipient, who is a natural person or a private law entity not required to register in professional registers or the business register and has elected the digital domicile, is carried out through ordinary methods.<\/p>","protected":false},"excerpt":{"rendered":"<p>NOTIFICAZIONE A MEZZO PEC: LE SEZIONI UNITE INTERVENGONO SUL REGIME PRE RIFORMA CARTABIA Le Sezioni Unite della Corte di Cassazione, con sentenza n. 28452 del 05 novembre 2024, hanno risolto il contrasto giurisprudenziale in ordine al perfezionamento della notifica a mezzo PEC, in caso di mancata consegna al destinatario con l\u2019attestazione \u201ccasella piena\u201d.
