{"id":5769,"date":"2026-10-12T00:00:42","date_gmt":"2026-10-11T22:00:42","guid":{"rendered":"https:\/\/dl-law.it\/?p=5769"},"modified":"2026-10-09T14:50:06","modified_gmt":"2026-10-09T12:50:06","slug":"falsa-testimonianza-il-licenziamento-e-legittimo-se-viene-meno-la-fiducia","status":"publish","type":"post","link":"https:\/\/dl-law.it\/en\/falsa-testimonianza-il-licenziamento-e-legittimo-se-viene-meno-la-fiducia\/","title":{"rendered":"FALSE TESTIMONY: DISMISSAL IS LAWFUL WHERE TRUST HAS BEEN IRREPARABLY UNDERMINED"},"content":{"rendered":"<p><strong>FALSE TESTIMONY: DISMISSAL IS LAWFUL WHERE TRUST HAS BEEN IRREPARABLY UNDERMINED<\/strong><\/p>\n<p>In Order No. 25687 of 22 September 2026, the Court of Cassation clarified that statements made during witness deposition are not, in themselves, exempt from possible disciplinary assessment.<\/p>\n<p>The case concerned an employee who was dismissed after giving testimony in civil proceedings brought by her sister against the company, which the employer considered to be untrue and damaging to its reputation, as they were intended to attribute conduct to the employer that was not in compliance with health and safety at work regulations.<\/p>\n<p>Both the first-instance court and the Court of Appeal declared the dismissal invalid, considering it irrelevant to ascertain whether the statements were true.
