CONSTITUTIONAL COURT: NEW RULING OF UNCONSTITUTIONALITY ON THE JOBS ACT

For employees hired as of March 7, 2015, by companies that do not exceed the size threshold referred to in Article 18 of Law No. 300/1970, the unlawfulness of dismissal will therefore result in the payment of compensation ranging between 3 and 18 months' salary, that is, the compensation provided for in Article 3 of Legislative Decree No. 23/2015, halved.

This follows ruling No. 118/2025, in which the Constitutional Court declared the partial unconstitutionality of Article 9, paragraph 1, of Legislative Decree No. 23/2015, specifically with regard to the words “and in any case may not exceed the limit of six months’ salary.”
