ARTIFICIAL INTELLIGENCE AND LABOR: THE NEW FEATURES OF THE NEW LAW

On 17 September 2025 the Senate of the Italian Republic, following the favorable vote of the Italian Chamber of Deputies occurred on 25 June 2025, definitively approved the text of the draft law (DDL) No. 1146-B concerning provisions and powers delegated to the Government regarding artificial intelligence, which will enter into force as law once it is published in the Official Gazette of the Italian Republic.

The text of the new law aims both at promoting “the proper, transparent and responsible use of artificial intelligence in an anthropocentric context” and at ensuring “the monitoring of economic and social risks and the impact of artificial intelligence on fundamental rights” (Art. 1 para. 1).

Its articles shall be interpreted and applied in accordance with Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 (the so-called ‘AI Act’).

It includes specific provisions intersecting with labor law, which establish that:

  • in the field of labor, AI should be used to “improve working conditions, protect the physical and mental integrity of workers, and increase the quality of work performance and productivity of individuals” (Art. 11 para. 1);
  • in the work context, the use of AI “must be safe, reliable, transparent and cannot be carried out in a manner that conflicts with human dignity or violates the confidentiality of personal data” (Art. 11 para. 2);
  • AI “in the organization and management of the employment relationship guarantees compliance with the inviolable rights of workers without discrimination” (Art. 11 para. 3);
  • the Observatory on the adoption of artificial intelligence systems in the labor world is established, with the function of “defining a strategy on the use of artificial intelligence in the workplace, monitoring its impact on the labor market and identifying the sectors of work most affected by the advent of artificial intelligence” (Art. 12);
  • with regard to intellectual professions, the use of AI “is intended solely for the performance of activities that are instrumental and supportive to professional activities, with a prevalence of intellectual work that is the subject of the service provided” and must be disclosed to the client (Art. 13).
