SALARIES AND COLLECTIVE AGREEMENTS: THE ENABLIG ACT INCOMING

On 23 September 2025 the Senate of the Italian Republic, following the favorable vote of the Italian Chamber of Deputies occurred on 6 December 2023, definitively approved the text of the draft law (DDL) No. 957 concerning powers delegated to the Government regarding workers' remuneration and collective bargaining, as well as control and information procedures, which will enter into force as law once it is published in the Official Gazette of the Italian Republic.

The text of the new law is based on Article 36 of the Constitution.

Indeed, it aims at delegating the Government to adopt (within six months of the law coming into force) one or more legislative decrees to:

  • “ensure the implementation of workers' right to proportionate and sufficient remuneration” by strengthening collective bargaining and establishing criteria that recognize the application of the minimum overall economic conditions provided for in the most widely applied national collective bargaining agreements;
  • “increase transparency in wage and contract dynamics at national and regional level and for each category of workers and each sector of activity” and “effectively combat contract dumping, unfair competition, tax and social security evasion and the use of undeclared or irregular forms of work to the detriment of workers”.

In relation to such goals, the normative text also establishes the guiding principles and criteria that the Government must adhere to in exercising its delegated powers.

Public administration employees and the collective agreements relating to them are expressly excluded from the scope of application.
