GEOLOCATION SYSTEMS FOR SECURITY GUARDS: THE INL'S CLARIFICATIONS ON REMOTE MONITORING
With note no. 1511 of 16 February 2026, the National Labor Inspectorate (INL) provides an opinion on the configuration of remote controls through the use of geolocation systems installed on the equipment of private security personnel.
In particular, it responds to a request for an opinion on whether the use of geolocation systems (GPS) supplied to security guards, which is mandatory under Ministerial Decree No. 269/2010, makes such systems comparable to the tools used by workers to perform their work duties.
The Authority responds negatively, stating that such systems cannot be considered a “work tool” within the meaning of Art. 4 para. 2 of Law 300/1970 (the so-called Workers' Statute).
This is because the requirements that the GPS system is intended to meet are organizational, productive, and security-related: therefore, although such geolocation systems are an essential technical requirement for companies in the security sector, they are not a necessary tool for work performance.
As a result, in order to use them, the trade union agreement or authorization procedure pursuant to Art. 4 para. 2 of the Workers' Statute must be followed.
